Trademarks

In each country, trademark laws are similar and different in some respects. It depends on the type of your product or service. If you plan to conduct business in Thailand, you need to register a trademark in Thailand to prevent copying, or imitation of your trademark. The sooner you register it, the more beneficial it will be for you. Because you will have to prove that you are the owner of the trademark before them.

When you register your trade mark, you’ll be able to:

  • take legal action against anyone who uses your brand without your permission, including counterfeiters
  • put the ® symbol next to your brand – to show that it’s yours and warn others against using it
  • sell and license your brand

Registering a trademark seems easy, but there are a lot of restrictions on registration. Some words, certain symbols you could not register. You may have to sacrifice something to own something. Getting registered with a trademark officer is not easy. If your trademark is not approved, you will have to appeal the officer’s order, which takes time and expertise to execute.
