Currently, there are lands in several categories, the first one is land ownership, and the second one is various types of land title documents issued by the government. Some of those lands can be sold, but before committing to purchase any land you must know what kind of land can transfer ownership rights leasehold to avoid potential problems in the future.
Land Nor Sor 4, Nor Sor 4 Jor, as well as it called “Chanote” there has a Red Garuda symbol on top of the title deed and is a document issued and certified by the Land Department to show ownership of the land.
The landowner whose name is after the title deed can fully enjoy the benefits from that land, have legal rights able to transfer, purchase, sell, mortgage, and guarantee.
Chanote is the most popular for sale and has the highest price value among other types of land. The seller and purchaser must register the transfer of ownership at the land office in the area where the land belongs only otherwise it will be considered void.
Nor Sor 3 Gor Land has a Green Garuda symbol on top of the title deed and is a certificate of utilization (possession rights), It is a title deed issued by the government to certify that the landowner can possess and use the land. Nor Sor 3 Gor land has a clear location on the aerial photographs.
This type of land may be sold, transferred, leased, usufruct, or mortgaged in the same manner as land with a freehold title deed (Chanote) as long as it is ready to be a full title deed.
In order to upgrade Nor Sor 3 Gor to a Chanote, the landowner may file a petition to the Land Department to file a request to upgrade it to a full title deed (Chanote), and the Land Department may do so if there is no opposition made against the petition.
Nor Sor 3, Nor Sor 3 Kor. has a Black Garuda on top of the title deed and is a certificate of utilization issued by the government to land occupants in general. There will be no aerial photographs. It looks like a floating map. There is no definite land location, or in some cases used in areas without aerial photographs.
The difference between this type of land title deed and the Nor Sor 3 Gor is that a land with Nor Sor 3 title has never yet been measured by the Land Department; hence the land has no exact boundaries.
The Nor Sor 3 title may be upgraded title to a Nor Sor 3 Gor and then subsequently upgraded to a freehold title deed (Chanote) in the future. This type of land is worth buying, it will allow you to purchase land at an affordable price and you have the legal right to own the land then upgrade it later.
Sor.Por.Gor. 4-01 land has a Red Garuda/Blue Garuda and is the right document for people to take advantage of the land reform area. The owner has the right of possession for residential and agricultural use only, and can’t issue title deed, purchase, sell, or transfer rights to others who are not the heirs of the owner.
This type of land can only be rented for agricultural purposes and cannot be mortgaged, except for government projects that allow the use of the Sor Por Gor 4-01 title deed as collateral.
The Sor Por Gor. 4-01 Garuda and Chanote Garuda looks similar you have to see the title name, the Sor Por Gor. 4-01 is “Benefits in the land reform area” and Chanote is “land title deed”.
Ratchaphatsadu land is all types of immovable property belonging to the state except for the public property of the state, with the Treasury Department (“TD”) as the administrator. The TD will allow people to occupy the land for residence by collecting annual rent. Calculate the rental rate according to the amount of usable space. You will be entitled to use the land legally only with a contract and direct permission from the TD
You can purchase a leasehold of the state property from the current lessee at a low price compared to other title deeds documents. You must contact the TD to transfer the leasehold directly to protect your rights by the law.
Nor Sor. 2 Baijong (preemption form) is issued by the government to the people to permit temporary possession and utilization of the land.
This type of land cannot be transferred to other people but can be transferred on the inheritance. The rightful person has the right to upgrade a preemption form to a certificate of utilization (Nor Sor 3, Nor Sor 3 Gor, or Nor Sor 3 Kor) or a Chanote but must bind under the transfer regulations prohibiting specified by law, Therefore, whoever is purchasing and selling this type of land must understand the conditions and discuss with your legal expert and the land officer clearly, you should avoid committing into a sale-purchase agreement with the owner privately.
The land title document, Phor.Bor.Tor.5, is a local maintenance tax filing form. Not a document of land ownership. This type of land is often empty land without any documentary rights. It is residentially inherited from generation to generation. The real owner of the land is the state.
This type of land “cannot” be traded or transferred. But most of them are trading like a gentleman writing. There are often problems suing each other. When your case goes to court there will be no legal support. The purchaser cannot use the evidence of trading to submit to the court for any consideration. because it is state land.
This land title document, SorTorGor. is a document issued by the Royal Forest Department so that people have the right to make a living in the forest area. If the people who receive the right do not use such land or abandon the land for more than 2 consecutive years, the Royal Forest Department can reclaim it immediately. This type of land cannot be traded or transferred but can only be handed down to the heirs.
Land title document Sor Kor. 1 is a document notifying the possession of land in the past (now no longer exists). In those days, the Land Department allowed people who occupied vacant land to report their land ownership. It is not evidence issued by the government It is just a notification form of land ownership of the people only.
If you want to purchase this type of land, we suggest making a clear written agreement, to prevent the original owner from claiming the rights back. Because, at present, the Land Department has allowed people to submit a request to prove their right to issue a Chanote or a certificate of utilization (Nor Sor 3, Nor Sor 3 Gor, or Nor Sor 3 Kor)
Nor Sor. 5 Land (Inquiry Certificate) is a document showing the investigation for the issuance of title deeds, not a title deed but can be registered under the Land Code and can be transferred if the land has an investigation certificate and a certificate of utilization or if it is a registration of the transfer of inheritance.
There are other types of land in Thailand but please note that if they are not mentioned in this article then you should not risk purchasing them at all. However, all the land we mentioned is whether you own the land. possession or being a lessee of state property. You shouldn’t abandon the land unused because it may cause you to lose that right.
